Arizona Proposition 202 - Stop Illegal Hiring
If passed the "Stop Illegal Hiring" Act would revoke the business license of employers who knowingly or intentionally hire illegal immigrants. This initiative also increases penalties for identity theft, as illegal immigrants often use stolen identities to conceal their undocumented status. Fines collected as a result of this initiative will be distributed to schools and hospitals to help deal with the financial burden placed on Arizona because of illegal immigration.

Will you vote in favor of Proposition 202?
1) Yes, we need tough but fair laws to compel employers to stop hiring illegal immigrants.
2) No, this proposal actually weakens Arizona's existing employer sanctions law.
Advocates of Proposition 202 say that: "Stop Illegal Hiring creates a mechanism for law enforcement to target the underground, black market, all-cash economy" and "creates tougher penalties for identity theft." It would make "it a crime for an employer to accept false identification from a potential employee" and "ensures that employers are out of business if they are found to be guilty of hiring illegal aliens." "Stop Illegal Hiring ensures that complaints against businesses are not anonymous, false or frivolous," and "creates an environment where businesses that follow the law have a bullet-proof defense." It "doesn’t mandate use of flawed database."
Opponents of Proposition 202 say that: "Arizona has the most effective, non-discriminatory employer sanctions law in the nation and it has been upheld in 4 court challenges." "Instead of stopping illegal hiring, this ballot measure will actually gut the existing employer sanctions law passed by the Arizona State Legislature. The current law requires employers to check if new employees are U.S. Citizens using the E-verify system, a simple verification system already in place through the U.S. Department of Homeland Security." "...businesses not requiring a license are automatically exempt. Also exempt from punishment are incorporated companies, partnerships and Transaction Privilege Licenses. Most corporate retailers like restaurants, hotels and retail chains are exempt."
UPDATE: Proposition 202 failed with 59% of the voters voting no.

Prop 202 is a Wolf in sheep’s clothing. It basically destroys the current Employers Sanction Law and was created by big business wanting to hire cheap illegal labor so they do not have to pay decent wages to LEGAL workers.

If you want to stop an invasion, you have to stop feeding it. I don’t believe that the illegals are doing work that Americans “will not do”. Honest people will work at anything for a decent wage. You could give the illegals some work, though…hire them to clean up the despicable mess they leave behind when sneaking acroaa the border to come here. The trash, the backpacks, the bottles, the food, the dirty diapers…yes, please do clean that up…on your way back to Mexico. Come back when you can do so legally.
Well, sure–anyone will do work any work for a decent wage. Unfortunately a decent wage is much less for an undocumented immigrant than an American, and a lot of employers can only afford to pay the lower one. This is not new; this is part and parcel of capitalism. The comfort of the upper and middle classes is contingent upon the existence of a significant reservoir of cheap labor at the bottom–otherwise the whole pyramid collapses. Mexicans and Central Americans are just the latest immigrant groups to form this base…and just like the others, are treated as though they built the pyramid.
Damnit, this is another trick title? Says one thing and does another, I hope there is a special place in hell for liars and manipulators.
This is exactly why I hate propositions. Were a Republic, not a direct Democracy damnit, and the Constitution guarantees every state a “Republican form of government.” Propositions are unconstitutional.

Great question - it proves 3 things:
1) You have not read the current law
2) You have not read the Federal Law
3) You have not read prop 202.
Wake Up Arizona is the same group who challenged the current law in the Federal District Court and twice in the 9th Circuit Court of Appeals and lost all three (3) challenges. After they lost in the courts the same group vowed to unseat Representative Russell Pearce and anyone else who want secure borders and a balanced budget. So now tell me again why I would believe that this group would write an initiative to “Stop Illegal Hiring”? What a terrible fraud being placed on the people of AZ. - VOTE NO on 202.
I’m a local businessman with many deep connections in the construction industry. I asked my friends in the drywall and framing industries if they could hire Americans instead of illegals, they laughed. “I may get an American foreman for $20.00 an hour, but it is impossible to get them for the labor crews. After the last law went into effect I asked how they were getting along, could they get laborers? “yes, we did find Americans to fill the positions”.
There was more to the discussion than space here allows, but in the end, they found American citizens for labor, it took a little more time, but not much more on the payroll.
Anyone who thinks that business succeeds on the backs of the poor need to go back to the 1920s, or get a real job.
I have a tree trimming business here in Phoenix and I use only American help. I must get a hundred calls each season from people without accents looking for work.
The only difference between the two demographics is that the Americans won’t work without insurance and you aren’t insured unless you are on the payroll (taxes, etc).
But then maybe all the people that call me are illegal Canadians just down in Phoenix to work the summer when it’s 115 degrees!
All anyone has to do is look at who is behind Prop 202 to see who this is going to benefit… the people who have and will use cheap illegal labor. This prop was brought about by people in the fast food industry, argricultural industry, lanscaping and chambers of commerce. They tried to stop our employer sanctions law in ourt several times and failed… even before a 9th circuit judge! Now they are counting on fooling people into voting their way. They called this prop ‘Stop Illegal Hiring’ for one reason only. They know that the majority of Arizona voters want illegal hiring stopped. They are counting on the voters to see the title, believe it and vote yes for it because that’s what they want. they are counting on voters NOT looking at what Prop 202 REALLY is and does. It’s a lie that will destroy our current sanctions law and make it easier for people to hire illegals without fear of any prosecution.
Sure, Prop 202 has ’stiffer penalities’ for employers but stiffer penalties do NO GOOD when they can’t be enforced. Prop 202 makes enforcement IMPOSSIBLE!
If you want to put an end to illegal immigration and the loss of American jobs to illegal aliens, please, VOTE NO ON 202.
I have bible-thumping, subsidy-grubbing, “wetback”-hiring uncles in my family who will vote yes on 102 in this election to preserve our nation’s moral fabric, and turn right around and hire gobs of illegal aliens to hoe their fields and bring in their crops so that that can usurp the whole intent of this nation’s “minimum wage” and see nothing wrong with it.
Have you ever heard the argument that without the johns, there’d be no hookers? or that without the junkies, there’d be no dealers? Same holds true here. Without Americans willing to break the law and hire illegals to work here, there’d be no illegals here.
I am still trying to figure out the wording of this proposition before deciding how to vote but would just like to say that in my world, one person deserves the same rate of pay for the same job. The same benefits for the same job. We call ourselves Christian, and then refuse to offer the same benefits to people who are not protected by our laws. Isn’t it a shame that to do the right thing we have to have laws? I say penalize anyone who hires illegal aliens and mark them for the anti-humanists they are.
I am glad to see there are some people that have been able to decipher their tricky language…Now comes the hard part, we must inform as many people as possible…I am upset with the fact that they do not disclose in the prop. that you will no longer be able to anonymously report employer who have violated the law…And that it will gut the E-Verify, and subsequently cause unemployment to rise…
I don’t know if you have noticed but the freeways seem to move better since E-verify… Also now when I order at KFC they get it right..

Judy you are way off on your assessment of Prop 202. It protects corporations, partnerships and other entities from prosecution, rewrites federal laws and definitions of hiring illegal aliens, stolen identity and paying workers cash under the table. You can find arguments against Prop 202 as well as the written court decisions of Judge Neil Wake and the 9th Circuit Court of Appeals which upheld the existing law and defined the unconstitutional provisions of Prop 202 at http://www.dongoldwater.info.

Isn’t everyone getting a little tired of the whole illegal thing. Small business employers hire illegals so they get away with paying next to nothing for wages. The big business employers get away with it by sending the work to China or something. They don’t care about the American people. They care about how deep their pockets are. Then they always say “Americans won’t do those jobs”. They are full of it. They just didn’t offer the jobs under the fair wage act. I know plenty of people that would die for a job. Go check out the homeless shelters. They are full of people that I bet would take those jobs. I’m getting a little tired of supporting everyone else but when it comes to our own starving kids I don’t see many comercials about them.
The only legitimate vote for this proposition is NO! Anyone voting in favor of this sham proposition supports modified slavery!!

Hypothetical situation:
You live in Texas - Texas’ minimum wage is $3 an hour. You have a famiy to support.
In New Mexico they pay $10 an hour minimum wage. But everyone in New Mexico doesn’t want you there because they don’t want to lose the job opportunity.Or they just figure your unsuitable to be a New Mexican. Figuring that the average New Mexico worker is making $25 and the bottom of the rung (Mcdonalds cook) is making the $10. Also,understanding that the process to be come a New Mexico citizen is too expensive for your family and would take years, would you move?
